Terms of Service

By accessing this Site, submitting a form, requesting a quote, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using our services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the Site. Your continued use of the Site following any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Ace Pallet Service is a full-service pallet company located in Warren, Michigan. We provide the following services, which are described in greater detail on the relevant pages of our Site:

• Pallet buying and selling: Purchase and sale of new, used, recycled, and refurbished wood and plastic pallets in standard and custom sizes.
• Pallet recycling: Collection, sorting, and environmentally responsible recycling of used and damaged pallets.
• Pallet repair: Inspection, refurbishment, and restoration of damaged pallets to functional condition.
• Transportation: Pickup and delivery of pallets within our service area in Southeast Michigan.
• Pallet management programs: Ongoing pallet supply, recovery, and inventory management solutions for businesses.

The availability, scope, and pricing of services may vary and are subject to change without notice. Specific terms for individual orders or service agreements may be documented in separate written quotes, invoices, or contracts, which shall supplement and, where applicable, supersede these general Terms.

All prices quoted on the Site or in communications from our team are estimates and are subject to change based on market conditions, pallet availability, condition, quantity, and other relevant factors. A binding price is established only when confirmed in a written quote or invoice issued by Ace Pallet Service.

Payment terms are specified on individual invoices. Unless otherwise agreed in writing, payment is due upon receipt of invoice. We accept payment by check, ACH transfer, wire transfer, and other methods as agreed upon. Late payments may be subject to a service charge of 1.5% per month (or the maximum rate permitted by Michigan law, whichever is lower) on the unpaid balance.

Customers are responsible for all applicable taxes, duties, and fees associated with their orders, unless otherwise stated in writing.

Delivery dates and times provided by Ace Pallet Service are estimates and are not guaranteed. We make commercially reasonable efforts to fulfill delivery schedules promptly, but shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to weather, traffic, vehicle breakdown, supplier delays, or force majeure events.

Delivery is available within our service area in Southeast Michigan. Delivery fees, if applicable, will be communicated at the time of quoting and confirmed on the invoice. Risk of loss and title to products passes to the customer upon delivery to the designated location.

Customers are responsible for providing safe, accessible delivery locations. If a delivery cannot be completed due to site conditions, access restrictions, or the customer's failure to receive the shipment, additional delivery charges may apply.

If you are dissatisfied with your order or believe the pallets received do not match the grade or specifications quoted, you must notify us in writing within seven (7) business days of delivery. Claims submitted after this period may not be honored.

Upon receiving a valid claim, we will investigate the issue and, at our sole discretion, may offer a replacement, credit, or refund. Pallets that have been modified, damaged by the customer, or used after delivery may not be eligible for return or credit.

Returns of accepted pallets require prior written authorization from Ace Pallet Service. Unauthorized returns will not be accepted. Return shipping costs are the responsibility of the customer unless the return is due to an error on our part.

To the fullest extent permitted by applicable law, Ace Pallet Service, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising out of or related to your use of our Site, services, or products, regardless of the cause of action or the theory of liability.

Our total cumulative liability to you for any and all claims arising out of or related to these Terms, our Site, or our services shall not exceed the total amount paid by you to Ace Pallet Service during the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation of liability applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other basis, even if we have been advised of the possibility of such damages.

All products and services are provided “as is” and “as available.” Ace Pallet Service makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Used and recycled pallets are sold based on grading standards described on our Site. While we make every effort to accurately grade and describe our products, normal variation in condition, appearance, and dimensions is inherent in used wood products and does not constitute a defect or misrepresentation.

The information on our Site, including product descriptions, specifications, pricing, and service details, is provided for general informational purposes and may contain errors or inaccuracies. We do not warrant the completeness, accuracy, or timeliness of any information on the Site.

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of our Site or services shall be brought exclusively in the state or federal courts located in Macomb County, Michigan, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

All content on the Site, including text, graphics, logos, images, and software, is the property of Ace Pallet Service or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content on the Site without our prior written consent.

The Ace Pallet Service name, logo, and all related marks are trademarks of Ace Pallet Service. Nothing on the Site grants you any license or right to use any trademark displayed on the Site without our written permission.
